Persons exempted from work permits

(i) Owner or capital contributor of a limited liability company with the capital contribution value of VND 3 billion or more.

(ii) Chairman or member of the Board of Directors of a joint stock company with the capital contribution value of VND 3 billion or more.

(iii) Entering Vietnam for a period of less than 3 months to do marketing of a service or to a resolve complicated technical or technological issue which affects or threatens to affect business operation and cannot be resolved by Vietnamese experts or any other foreign experts currently in Vietnam.

(iv) Foreign workers who are internally moved within an enterprise operating in the 11 service sectors in the list of Viet Nam’s commitments on services to the World Trade Organization, including: business, communication, construction, distribution, education, environment, finance, healthcare, tourism, cultural entertainment and transport;

(v) Entering Vietnam to provide professional and technical consulting services or perform other tasks for projects using the official development assistance (ODA) funds.

(vi) Volunteers; students studying in foreign schools and institutions having agreements on internship in agencies, organizations and enterprises in Vietnam.

(vii) Entering Vietnam to work as managers, executives, specialists or technical workers with the working duration of less than 30 days and for no more than 3 entry times in a year.

(viii) Person who is responsible for establishing a commercial presence.
The above persons need to apply for certifications that they are not the objects of work permit exemption, except for those specified in the items (i), (ii), (iii) and (vii) above.
